On December 7, 2022, Young Innovations, Inc, which owns the U.S. federal trademark registrations for YOUNG® and YOUNG SPECIALTIES® for a wide array of dental goods, sued US Dental, Inc., dba Young’s Dental, Young’s Dental, Inc., Peter S. Park, and Richard Park in the United States District Court for the Northern District of Illinois. Young Innovations alleged that, among other things, the Defendants were using colorable imitations of Plaintiff’s trademarks in connection with the Defendants’ dental goods and services, and that Defendants’ acts were likely to cause confusion.
On November 27, 2023, the Illinois Federal Court entered Default Judgment against Defendants Young’s Dental, Inc. and Richard Park. The Court found that these two Defendants are liable for willful trademark infringement and counterfeiting, unfair competition, false advertising, and false designation of origin under the Lanham Act, violation of the Illinois Uniform Deceptive Trade Practices Act, violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, and unfair competition under Illinois common law. Among other things, the Court ordered these two Defendants to cease selling, marketing, advertising or promoting any dental goods or services that constitute a counterfeit, copy, confusingly similar variation, or colorable imitation of Plaintiff’s YOUNG® or YOUNG SPECIALTIES® trademarks. The Court also ordered that any domain names owned by these two Defendants that incorporate the terms YOUNG®, YOUNG SPECIALTIES®, or a colorable imitation thereof, including the domain names youngsdental.com and youngsdigital.net, shall be changed from the current registrant to Plaintiff. Plaintiff Young Innovations is now the owner of those domain names.
